These Terms of Use (the "Terms") are an agreement between Kaibu ("Kaibu," "we," "us,"
or "our") and you, the person using our service. Kaibu is a platform that generates
home cooked meal plans and recipes for your dog based on details you provide, such as
age, weight, activity level, and food preferences. Our website at feedkaibu.com, together
with the planning tools, accounts, and related features we offer through it, are the
"Service." By creating an account or using the Service, you agree to these Terms. If you
do not agree, please do not use the Service.
Kaibu helps you plan and prepare food for your dog. It does not provide veterinary care
or medical advice, and the recipes are a guide, not a prescription. Always talk with your
veterinarian before changing your dog's diet, especially if your dog is a puppy, pregnant
or nursing, a senior, or has a health condition. See Section 6 for the full nutrition and
veterinary disclaimer.
1. Acceptance and changes to these Terms
By accessing or using the Service, you confirm that you have read, understood, and agree
to be bound by these Terms and by our Privacy Policy. We may update these Terms from time
to time. When we do, we will change the date at the top of this page, and where the changes
are significant we will try to give you notice, for example by email or a notice within the
Service. Your continued use of the Service after an update means you accept the revised
Terms, so please check this page from time to time.
2. Who can use Kaibu
Kaibu is intended for dog owners who are at least 18 years old and located in the United
States. By using the Service you confirm that you meet these requirements. We make no claim
that the Service is appropriate or available for use outside the United States, and if you
access it from elsewhere you do so at your own risk and are responsible for complying with
your local laws.
3. Your account
To use the planning tools you create an account. You are responsible for the information you
provide and for keeping your login details secure. Please keep your details accurate and up
to date, do not share your password or let others use your account, and let us know promptly
if you believe your account has been accessed without your permission. You are responsible
for activity that happens under your account. We may suspend or close an account that we
believe is being misused or is in breach of these Terms.
4. Communications
When you create an account or use the Service, you agree that we may send you emails related
to your account and the Service, such as sign in links, security notices, and important
updates. These messages are part of the Service. You agree that notices
we provide electronically meet any legal requirement that they be in writing.
5. What Kaibu provides
Kaibu generates suggested meal plans and recipes for your dog using the details you enter and
a proprietary algorithm designed to target the nutrient profiles recommended by the
Association of American Feed Control Officials (AAFCO) for the life stage you select. Kaibu is
a planning and information tool. We do not sell, prepare, ship, or deliver food, ingredients,
or supplements, and we are not a pet food manufacturer. You buy your own ingredients and
prepare the food yourself. You can plan for your first dog at no cost. Where we offer paid
features, the price and what is included will be shown to you before you are charged. We may
add, change, or remove features of the Service at any time.
6. Nutrition and veterinary disclaimer
Kaibu's recipes and meal plans are provided for general informational and planning purposes
only. They are a guide, and they are not veterinary advice, a diagnosis, or a treatment plan.
Every dog is different, and a plan generated from the details you enter cannot account for
everything about your dog's health.
You are responsible for monitoring your dog's weight, body condition, and overall health, and
for adjusting course as needed. Consult your veterinarian before starting a new diet or making
significant changes to your dog's food, and especially if your dog is a puppy, pregnant or
nursing, a senior, or has any medical condition, allergy, or special dietary need. Your
veterinarian knows your dog's history and can examine your dog in person.
Nothing in the Service is intended to be, or should be relied on as, veterinary or medical
advice. To the fullest extent permitted by law, we are not responsible for any loss, injury,
illness, or harm to your dog or anyone else arising from your reliance on the recipes, plans,
or other information in the Service.
7. Preparing food, ingredients, and safety
Because you source ingredients and prepare the food yourself, you are responsible for:
- choosing ingredients that are safe and appropriate for your dog, and avoiding anything your dog is allergic or sensitive to,
- following the recipe, including any recommended supplements, quantities, and preparation steps,
- safe food handling, cooking, and storage, and
- checking that ingredients are fresh and free from anything toxic to dogs.
Some foods that are safe for people are harmful to dogs. If you are unsure whether an
ingredient or supplement is appropriate for your dog, check with your veterinarian before
feeding it. We are not responsible for ingredients you buy or for how food is prepared,
handled, or stored. By using Kaibu and feeding food you prepare yourself, you accept these
responsibilities and the risks that come with preparing food at home.
8. Acceptable use
You may use the Service only for your own personal, non-commercial use in planning food for
your own dogs, and only in a lawful way. You agree not to:
- resell, redistribute, or make the Service or its content available to others as a commercial offering,
- copy, scrape, data mine, or use bots, crawlers, or automated tools to extract recipes, content, or data from the Service,
- reverse engineer, or attempt to derive or copy, the algorithm or the way plans and recipes are generated,
- interfere with or disrupt the Service, or attempt to gain unauthorized access to it, its servers, or other users' accounts,
- upload anything harmful, such as viruses or malicious code, or
- use the Service to break the law or infringe anyone's rights.
9. Intellectual property
The Kaibu name, logo, the Service, and its content, including text, design, and the recipes
and meal plans generated for you, belong to Kaibu or its licensors and are protected by
copyright and other intellectual property rights. We grant you a limited, personal, non-transferable right to use
the Service and the plans it generates to feed your own dogs. This does not give you any right
to use the Kaibu name or content for any commercial purpose, or in any other way not allowed
by these Terms. All rights we do not expressly grant are reserved.
10. Information you provide
You keep ownership of the information you enter about yourself and your dogs. By entering it,
you give us permission to use it to operate and improve the Service, including to generate and
store your dog's plans, in line with our Privacy Policy. You are responsible for the accuracy
of the information you enter, and you confirm you have the right to provide it. The more
accurate your details, the more useful the plan.
11. Third party services and links
We rely on trusted third party providers to run the Service, for example for hosting,
databases, and email delivery. The Service may also link to third party websites or resources.
We do not control those third parties and are not responsible for their content, policies, or
practices. Any links are provided for convenience, and you use them at your own risk.
Kaibu may recommend third party products, such as Balance IT supplements, and may use publicly
available product information to build your plan. Kaibu is not affiliated with, sponsored by, or
endorsed by Balance IT or any other brand we mention, and we receive no compensation for these
recommendations. Product names and trademarks belong to their owners. Always follow the
manufacturer's label and check with your veterinarian before starting a supplement.
12. The Service is provided "as is"
We work hard to make Kaibu useful and reliable, but the Service and everything in it are
provided on an "as is" and "as available" basis, without warranties of any kind, whether
express or implied. To the fullest extent permitted by law, we disclaim all implied warranties,
including warranties of merchantability, fitness for a particular purpose, accuracy, and
non-infringement. We do not warrant that the Service will be uninterrupted, error free, or free
of harmful components, or that any recipe or plan will produce a particular result for your dog.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply
to you.
13. Limitation of liability
To the fullest extent permitted by law, Kaibu will not be liable for any indirect, incidental,
special, consequential, or punitive damages, or for any loss of profits, data, or goodwill,
arising out of or relating to your use of, or inability to use, the Service, whether based in
contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the
Service will not exceed the greater of the amount you paid us for the Service in the twelve
months before the claim, or one hundred US dollars ($100). Some jurisdictions do not allow
certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Kaibu from and against any claims, losses,
damages, liabilities, and costs, including reasonable legal fees, arising out of or relating to
your misuse of the Service, your breach of these Terms, or your violation of any law or the
rights of any third party.
15. Termination
You can stop using Kaibu at any time, and you can ask us to close your account. We may suspend
or end your access to the Service, in whole or in part, if you breach these Terms or misuse the
Service, or if we stop offering the Service. Sections that by their nature should survive, such
as intellectual property, disclaimers, limitation of liability, and indemnification, will
continue to apply after your account is closed.
16. Dispute resolution
If you have a concern or a dispute, please contact us first at
support@feedkaibu.com so we can try to resolve it
directly. Most issues can be sorted out this way. If we cannot resolve it, either of us may
bring the matter in small claims court, or in the courts described in Section 17.
17. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict
of laws rules. You agree that any dispute relating to these Terms or the Service will be handled
by the state or federal courts located in California, and you consent to their jurisdiction,
unless applicable law requires otherwise.
18. General
If any part of these Terms is found to be unenforceable, the rest will remain in full effect.
If we do not enforce a provision of these Terms, that is not a waiver of our right to do so
later. These Terms, together with our Privacy Policy,
are the entire agreement between you and Kaibu regarding the Service, and they replace any
earlier agreements on that subject. You may not transfer your rights under these Terms without
our consent, and we may transfer ours, for example if the Service is acquired.
